Nine pieces of essential legislation for professional recruiters

Here’s nine pieces of legislation that we think every recruiter should be aware of. We hope this will act as a refresher to experienced recruiters and as a useful reference guide for new recruiters.

1. Conduct of Employment Agencies and Employment Businesses Regulations 2003
Providing workers and hirers with minimum standards they can expect from employment agencies and employment businesses.

2. Agency Worker Regulations
Ensures that agency workers are given the same rights and pay as their directly employed, permanent counterpart (called a comparator).

3. Immigration, Asylum and Nationality Act
Prevention of illegal working in the UK.

4. Working Time Regulations
The working time regulations govern the hours most workers can work and sets limits on an average working week.

5. Intermediaries Legislation (IR35)
Designed to tax “disguised employment” at a rate similar to employment.

6. National Minimum Wage Act
Most workers will be entitled to the National Minimum Wage (NMW). Normally the NMW rate changes in October each year.

7. Equality Act
The Equality Act 2010 legally protects people from discrimination in the workplace and in wider society. It replaced previous antidiscrimination laws with a single Act.

8. Onshore Intermediaries Legislation
This piece of legislation is subtitled ‘targeting false self-employment’ and outlines the criteria for self-employment. Control, direction and supervision are the key deciders.

9. Offshore Intermediaries Legislation
With this piece of legislation HMRC are attempting to ensure that employer’s NI is paid in full for all workers in the UK.
